У видавництві Springer вийшла друком колективна монографія українського авторського колективу «Ukrainian Healthcare Law in the Context of European and International Law»,  Springer Nature Switzerland AG 2022. 276 р. У праці висвітлені актуальні питання приватного та публічного правового регулювання відносин у сфері охорони здоров’я та фармації. Зокрема, представлено український погляд на загально європейську проблематику: договори про охорону здоров’я та надання медичних послуг,  правовідносини трансплантології, посмертної репродукції та донорства, особливості сімейних прав особистої власності у сфері охорони здоров’я, проблеми правового регулювання праці медичних працівників, приватні правовідносини сурогатного материнства з іноземним елементом.

Співавтором цієї фундаментальної праці є провідний науковий співробітник нашого Інституту докторка юридичних наук Миронова Галина Анатоліївна. У підрозділі 2.2.  «The Doctrine of the Patient’s Personal Autonomy in Absolute Legal Relations: Directions of Improvement of the Legislation of Ukraine» (Р. 99-113) авторкою досліджено актуальні проблеми реалізації доктрини автономії пацієнта в абсолютних правовідносинах на матеріалах європейських правових актів, законодавстві країн ЄС, запропоновано шляхи імплементації європейських правових стандартів у законодавство України.  Abstract. This chapter is devoted to the analysis of the provisions of the legislation of Ukraine on the autonomy of the patient regarding the withdrawal from medical intervention. Modern factors of actualization of the declared topic are features of modern medical technologies and shift of ethical paradigm of relations in the field of medical care. During just a few decades, there have been significant changes in both the public consciousness and doctrinal approaches to the legal regulation of health care. The paternalistic approach was replaced by a contractual concept based on the principle of personal autonomy, and these objective processes need their scientific justification. The medical field is extremely sensitive to existing technological, ethical changes, because medicine directly affects the most intimate and vulnerable things that a modern person has: body, mind, feelings, beliefs, abilities, desires. Thus, medicine directly affects the physical and moral autonomy and inviolability of man, which are the highest values. Legal interpretation of the patient’s personal autonomy in medical care is based on the principle of informed voluntary consent. This fundamental principle is introduced into the legal plane through the system of special legal means—absolute rights that legally ensure self-determination and moral autonomy of the patient in private law relations in the field of medical care.
